Being
injured in a car accident in Korea can become even more stressful when the
victim is a foreign resident unfamiliar with the Korean legal procedure and
medical process. In a recent case, a foreign client suffered serious injuries
after a motor vehicle accident and was hospitalized for an extended period. The
injuries required multiple surgeries and left the client temporarily dependent
on a wheelchair while still undergoing treatment. Despite
the severity of the injuries, the insurance company allegedly pushed for a
quick resolution before the client had fully recovered or received a clear
medical opinion on long-term disability and daily life impact. This created a
serious risk that the client could sign a settlement too early and give up
claims before the true extent of the damages was known. Under
Korean law, compensation for motor vehicle accidents may include medical
expenses, future treatment, lost income, disability-related damages, pain and
suffering, and other losses depending on the facts of the case. However, once a
final settlement is signed, the victim may lose the ability to claim additional
compensation later. For this reason, accident victims should be extremely
cautious before agreeing to any final settlement while still in active treatment. Our
firm advised the client to preserve all evidence, including hospital records,
surgery records, imaging, receipts, transportation costs, rehabilitation
expenses, communications with the insurer, accident reports, and proof of the
impact on daily life. We also focused on the urgent issue of ensuring that
accident-related medical bills were properly addressed through the motor
vehicle insurance process, without treating medical payment as a final
settlement of the entire case.
